Approval principles for external qualifications for 16 to 18-year-olds

The qualification must support one or more of the following:

  • advanced level programmes in schools and institutions
  • work-based learning programmes such as Advanced and Foundation Modern Apprenticeships
  • other initiatives designed for 16 to 18-year-olds, such as the right to time off for study or training
  • progression to one of the above
  • broadening of experience or other development needs
  • the needs of low attainers and those with special needs.

Most learners of this age group should be aiming for substantial general, vocationally-related or occupational competence qualifications at levels 2 and 3 of the national qualifications framework which will enable them to progress further. This doesn’t preclude approval of level 4 qualifications.

For work-based learning programmes, qualifications will only be considered if they fit in with identified local or national skills needs.

Approval will also be considered for qualifications that provide one or more of the following:

  • some basic or key skills attainment
  • complementary, broadening or developmental opportunities at any level
  • a way in to sustainable employment
  • entry level and level one study that prepares students for level 2 and 3 qualifications, for the adult world or for work.

Guidance on external qualifications for 16- to 18-year-olds

Most qualifications are approved for use by all learners aged 16 and over. Some, owing to statutory restrictions, are approved only for those aged 18. These include the WSET Awards' Intermediate Certificate in Wines Spirits and Other Alcoholic Beverages. Those under 18 may prepare for the qualification if it is part of a recognised programme of study or they have written parental consent.

Courses not covered by the Act

The Act doesn’t cover courses or activities that don’t lead to external qualifications. The funding of such courses or activities is for funding authorities such as the Learning and Skills Council to decide. These might include:

  • National Curriculum assessment and testing arrangements required by law at Key Stages 1, 2 and 3
  • a record of achievement intended as a portfolio record of external qualifications achieved (although external qualifications offered within a system of record of achievement are regarded as qualifications requiring approval)
  • an employer's report of work experience. In some cases this may form part of an external qualification, but it is not in itself a qualification
  • any certificate awarded in a competition, competitive festival or quiz.

The legislation places a responsibility, in the case of maintained schools, on the local authority and the governing body to ensure compliance with the provisions.

In the case of other courses, the funding authority must ensure that only approved qualifications are funded.

The Secretary of State can direct a funding authority or governing body if he is satisfied that they have failed in their duty.
